People involved

When making an application for an order, a variety of people can be involved:

  • Applicant – person with an interest making the application

  • Adult – person over 16 years who is incapable of managing their own affairs

  • Relevant others – includes the nearest relative, named person, primary carer and any other person with an interest in the welfare and financial affairs of the adult (this could be a health or social work care manager).

  • Legal adviser – a practising solicitor who can provide legal advice, prepare the application and arrange for the supplementary reports.

  • Nominated intervener – the person being put forward to act as intervener

  • Mental health officer – an officer based at the local authority with expertise in mental health matters

  • Medical practitioner – medical doctor who is registered and licensed to practice in the UK
