What is a power of attorney?

Having a PoA lets you plan what you want another person to do for you in the future, should you become incapable of making decisions about your own affairs. PoA is a written document which includes a certificate signed either by a solicitor who is registered to practise law in Scotland or by a practising member of the Faculty of Advocates or by a registered UK medical doctor who holds a licence to practise.

You will need to arrange for your own PoA document to be drafted. This is not something we can help with as our role is to provide a registration service.

The law says that someone who is currently declared as bankrupt or if a protected trust deed is in place that they can make a PoA to deal with their personal welfare decision making but not about their financial and property affairs.

We provide a weekly update on our current processing times to keep you informed.

We appreciate that in some cases there is a genuine need for a PoA to be urgently processed due to the granter’s needs. If you wish to make an application to have a PoA expedited you must provide a reason why your PoA requires to be processed more urgently than the other PoAs waiting in the queue.    

Once your PoA is registered with us it will last unless you decide to cancel it. You should also be aware that particular changes in circumstance will result in the PoA coming to an end.
